This service (www.Easysender.com) is provided by ComNed to you ("you" or "user"),
subject to the terms of this Site User agreement ("Agreement"),
and the rules that may be published from time to time by EasySender.com.
The Services, provided by ComNed, are provided to User under the terms
and conditions of this Agreement and any amendments thereto,
and any operating rules or policies that may be published from time
to time by ComNed, all of which are hereby incorporated by reference.
This Agreement comprises the entire agreement between User and ComNed
and supersedes any prior agreements pertaining to the subject matter
contained herein. Easysender.com reserves the right to amend,
change and review the Terms and Conditions.
It is the USER'S responsibility to refer to these Terms and Conditions
regularly for any updates and amendments.
Continual use of the Easysender.com service constitutes acceptance of
the current Terms and Conditions.
Users who violate the terms of this Agreement will have their EasySender.com
account ("Account") cancelled and User may be permanently banned from
using EasySender.com.
ENTERING ANY LOGGED IN MEMBERS AREA OF EasySender.com WILL CONSTITUTE
ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.
IF YOU DO NOT AGREE TO ABIDE BY THESE TERMS, YOU MUST NOT USE THIS SERVICE.
USER'S REGISTRATION OBLIGATIONS:
User must be at least eighteen (18) years of age to register for this Service.
In consideration of use of the Services, User agrees to:
(a) Provide true, accurate, current, and complete information about User
as prompted by the registration form;
(b) To maintain and update this information to keep it true, accurate,
current, and complete. If any information provided by User ("Registration Data")
is untrue, inaccurate, not current, or incomplete, ComNed has the right to terminate
User's account and refuse any and all current or future use of the Services.
Rules:
Easysender.com is for personal use only.
You are entirely responsible and liable for all activities conducted through
your Easysender account. Listed below are some, though not all violations
that may result in EasySender.com terminating your Account.
You agree not to do any of the following actions while using EasySender.com:
Harass, threaten, embarrass or cause distress or discomfort upon another EasySender.com
participant, user, or other individual or entity;
Transmit via EasySender.com any information, data, text, files, links, software,
communication or other materials ("Content") that EasySender.com considers to be unlawful,
harmful, threatening, abusive, harassing, defamatory, illegally obscene or vulgar,
hateful, racially, ethnically or harms the intellectual property of a third party;
Impersonate in EasySender.com any person, including but not limited to an
EasySender.com member or Site personnel.
You may not use Easysender.com in any way that could cause damage, Impair, overburden
or disable Easysender.com or any networks connected or associated with Easysender.com
Intentionally or unintentionally violate any applicable local, state, national
or international law, including but not limited to any regulations having the force of
law while using or accessing EasySender.com or in connection with your use of
EasySender.com email community in any manner;
Use the Easysender e-mail system for marketing purposes.
You agree not send any commercial messages or advertisements
[either by itself or sent with content] without prior express written consent
by EasySender.com. Failure to do so will be deemed as spamming.
EasySender.com expressly reserves its rights to sue User for spamming activities to
the fullest extent provided by applicable state and/or federal law.
Spamming of any kind is not permitted and will not be tolerated.
Intellectual Property:
You agree that you will not upload or transmit any Content to EasySender.com that
infringes any intellectual property (copyright, patent, trademark, and/or trade secrets)
rights of either EasySender.com or a Third Party.
All inquiries regarding Intellectual Property rights violation must be sent by the aggrieved
party or their agent to support@easysender.com
Content Policy:
You must evaluate and bear the risk associated with the accuracy, completeness or usefulness
of any Content on EasySender.com. EasySender.com shall not be responsible for the accuracy
or consistency of any of its Content. EasySender.com does not pre-screen or monitor most,
if not all, of its Content areas as a matter of policy. Notwithstanding, EasySender.com reserves
the right, but not the responsibility, to remove Content which is deemed in EasySender.com's sole
discretion harmful, offensive, or otherwise in violation of this Agreement or any rules EasySender.com
has in place at the time.
EasySender.com may elect at its sole discretion to monitor some, all, or no areas of EasySender.com
for adherence to this Agreement or EasySender.com's rules.
Limitation Of Liability:
TO THE FULL EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, EASYSENDER.COM
SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING
FROM THE USE OR INABILITY TO USE EASYSENDER.COM OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND
SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR
TRANSACTIONS ENTERED INTO THROUGH YOUR COMMUNITY MAIL OR RESULTING FROM UNAUTHORIZED ACCESS TO
OR ALTERATION OF PROFITS, USE, DATA, OR OTHER INTANGIBLE PROPERTIES, EVEN IF EASYSENDER.COM HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EASYSENDER.COM IS PROVIDED "AS IS" WITH "ALL OR ANY FAULTS". BY USING EASYSENDER.COM,
YOU THE USER ACCEPTS FULL RISK. IN NO EVENT WILL EASYSENDER.COM BE LIABLE FOR ANY DAMAGES
INCLUDING WITHOUT LIMITATION ANY INDIRECT, CONSEQUENCIAL, INCIDENTAL, OR PUNITIVE, SPECIAL
DAMAGES ARISING RESULTING OR BASED ON THIS AGREEMENT OR YOUR USE OF THIS WEBSITE. IF YOU DO
NOT AGREE OR HAVE A DISPUTE WITH ANY PART OF THIS AGREEMENT THEN YOU MUST DISCONTINUE USE OF
THIS SERVICE OR ANY SITES UNDER THE EASYSENDER.COM TERMS AND CONDITIONS.
Termination:
You or EasySender.com may terminate your Account at any time for any reason.
Once your Account is terminated, you cannot access EasySender.com in any manner or for any
reason without re-registering to the site. Another Easysender.com user is not permitted to
help a terminated user to access the site using another Easysender.com account. Doing so will
also result in the termination of the assisting users accounts.
EasySender.com reserve the right to modify or discontinue, temporarily or permanently the
Services with or without notice to User. User agrees that EasySender.com, and their third
party service providers shall not be liable to User or any third party for any modification
or discontinuance of the Services.
You further recognize that the holder of the Account is entirely responsible for activities
conducted through such Account.
